Terms of Service

These Terms of Service ("Terms") govern your use of the Eara mobile application ("App") operated by Eara ("we", "our", "us"). By using the App, you agree to these Terms.

1. Description of Service

Eara is a sound therapy application designed to support tinnitus management through personalised pink noise sessions, guided meditations, and a structured 90-day protocol. The App requires compatible Bluetooth earbuds and an active subscription to access therapy features.

2. Account Registration

To use the App, you must create an account using a valid email address or through Apple/Google sign-in. You are responsible for maintaining the security of your account credentials and for all activity under your account.

3. Subscriptions & Redemption Codes

Access to Eara's sound therapy features requires an active subscription. Subscriptions are activated through redemption codes provided at the time of purchase from our website or authorised retailers.

Each redemption code activates a 12-month subscription
Codes are single-use and non-transferable
Subscriptions do not auto-renew; a new code is required to continue access after expiry
Refund requests for purchases should be directed to the retailer from which the product was purchased

4. Device Requirements

The App is designed to work with specific Bluetooth earbuds. A compatible device must be paired via Bluetooth to start therapy sessions. The App verifies device compatibility during the pairing process.

5. Medical Disclaimer

Eara is not a medical device. The App does not provide medical advice, diagnosis, or treatment. Sound therapy is intended as a complementary wellness tool and should not replace professional medical care.

Always consult a qualified healthcare professional about your tinnitus or hearing concerns
Do not use Eara as a substitute for medical treatment
If you experience pain, dizziness, or worsening symptoms while using the App, discontinue use and consult your doctor
THI assessments within the App are for personal tracking only and do not constitute a clinical diagnosis

6. Acceptable Use

You agree not to:

Share your account credentials with others
Attempt to reverse-engineer, decompile, or extract source code from the App
Use the App for any purpose other than personal tinnitus management
Circumvent device verification or subscription checks
Redistribute or resell redemption codes

7. Intellectual Property

All content within the App, including audio files, guided session scripts, user interface design, and branding, is the property of Eara and is protected by copyright. You may not reproduce, distribute, or create derivative works from any App content without our written permission.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Limitation of Liability

To the maximum extent permitted by law:

The App is provided "as is" without warranties of any kind, express or implied
We do not warrant that the App will be error-free, uninterrupted, or that it will produce any particular health outcome
We are not liable for any indirect, incidental, or consequential damages arising from your use of the App
Our total liability for any claim related to the App shall not exceed the amount you paid for your current subscription period

10. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may delete your account at any time by contacting us at support@tryeara.com. Upon termination, your right to use the App ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
